Terms and Conditions
HotShop Corporation and its subsidiaries licensed to operate under the “HotShop” trademark.
1. About these Terms
These Terms and Conditions ("Terms") are a legal agreement between you and HotShop Corporation, which operates the HotShop Hot Yoga studios ("HotShop", "we", "us"). They apply when you visit hot-shop.ca, use the HotShop app, create an account, book or attend a class, buy a membership or pass, or use any of our studios (together, our "Services").
By creating an account, booking a class or using our Services, you agree to these Terms. Section 6 (Health, assumption of risk and release) limits your legal rights, including your right to sue us. Please read it carefully.
These Terms should be read with our Privacy Policy, Cancellation Policy, Community Pledge and any other studio policies posted on our website or in our studios.
2. Eligibility
You must be at least 18 to create an account and buy memberships or passes on your own.
Participants under 18 may attend classes with a parent or legal guardian's involvement, as follows:
Ages 14 and 15: a parent or guardian must be present in the studio during the class
Ages 16 and 17: a parent or guardian must give written consent
Under 14: not permitted
In every case, the parent or guardian must create or approve the booking, read these Terms on the minor's behalf, and sign our Parental Acknowledgment of Risk and Indemnity. The parent or guardian is responsible for all fees and for the minor's conduct in the studio.
3. Accounts
You need an account to book classes. Give us accurate information and keep it up to date. You are responsible for activity on your account, so keep your password private and tell us right away at talktous@hot-shop.ca if you think someone else has used it. Accounts are personal and may not be shared.
4. Memberships, passes and payments
The rules in this section apply to HotShop memberships and passes. Reformed memberships are governed by the policies posted at reformedpilates.ca. Memberships and passes cannot be used at the other studio.
Payments. Bookings and payments are processed through our booking platform, Mariana Tek, and its payment processor, including purchases made in the HotShop app. We do not store your full card number. Prices are subject to applicable taxes as shown at checkout.
Recurring memberships. Memberships renew automatically each billing period and are charged to the card on your account until you cancel. Keep your card details current; if a payment fails, we may suspend your bookings until it is paid.
Cancelling a membership. You may cancel a recurring membership at any time with at least 30 days' notice. To cancel, email us through our contact page and complete the cancellation form we send you. Your cancellation is not processed until we receive the completed form. If a renewal payment falls within your 30-day notice period, you will be charged for it and keep full access until the end of that billing period. Example: if your next billing date is May 15 and your completed form is received on April 20, you will be charged on May 15 and keep access until June 14. A membership cannot be cancelled while it is paused, and cannot be paused after you have given cancellation notice.
Pausing a membership. You may pause your membership up to 2 times per year, for up to 60 days in total, by contacting us through our contact page. Your membership rate stays locked in while paused. Pauses are how we accommodate injury, surgery, pregnancy, travel, relocation and family emergencies; for a medical pause, we may ask for a doctor's note where the law allows. We do not otherwise offer early cancellation.
Single sessions and session packs. Single sessions and multi-session packs expire 6 months after purchase and are non-transferable.
Late cancellations and no-shows. You may cancel a class reservation up to 6 hours before class with no penalty. If you cancel with less than 6 hours' notice:
if you booked with a single session, multi-session pack, or 4, 8 or 12 sessions-per-month membership, you lose the session credit you booked with
if you booked with an unlimited membership, you are charged $20 plus GST
If you don't attend a class you booked with a single session, multi-session pack, or 4, 8 or 12 sessions-per-month membership, you lose the session credit and are also charged a $20 plus GST no-show fee. If you don't attend a class you booked with an unlimited membership, you are charged a $20 plus GST no-show fee. Cancel in the HotShop app or on our website to avoid these fees.
Free trials and intro offers. Each person may use a free trial or intro offer once. If a trial converts to a paid membership, you will be charged when the trial ends unless you cancel before 11:59 p.m. Mountain Time on the last day of the trial.
Refunds. Payments are non-refundable, including for unused classes or time, except where required by law or where we cancel a service we have charged you for.
Price changes. We will give members at least 30 days' notice by email before a membership price increase takes effect.
Offers and promo codes. Discounts and promotions are subject to their stated conditions, may be time-limited, and may be withdrawn at any time. A past offer does not entitle you to future offers.
Schedule changes. We may change, cancel or substitute classes, instructors or times. If we cancel a class you booked, your class credit will be returned.
5. Studio conduct
HotShop is an inclusive community, welcoming to people of any age, size, skill level, background or identity. When you visit, please:
arrive in time to settle in; if you have not arrived 5 minutes before class, your spot may be released to a waitlisted member, and no one is admitted once class has started
stay for the full class, including Savasana and cool-downs
leave your phone outside the studio room and keep smartwatches and wearables out of your practice
stay silent once you enter the yoga room
wear grip socks for Mat Pilates
follow your instructor's directions and use equipment, including spin bikes, only as shown
tell staff about damaged equipment or unsafe conditions
do not photograph or film other members without their consent
do not attend under the influence of alcohol or drugs
Harassment, threats, violence, bullying, or discrimination based on race, ethnic origin, religion, disability, gender identity, sexual orientation, age, size or any other characteristic will not be tolerated, whether directed at members or staff. We may refuse service, suspend or cancel the membership of anyone who breaks these rules, without refund.
Photos and video. We sometimes take photos and video in our studios for marketing and social media. We will let you know when filming is happening. If you prefer not to appear, tell your instructor or the front desk.
6. Health, assumption of risk and release
PLEASE READ CAREFULLY. THIS SECTION AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO SUE.
Heated classes. Our hot yoga rooms are heated to approximately 40°C with about 50% relative humidity, and combination classes move between the spin room and the hot room. Exercising in heat increases the risk of dehydration, dizziness, fainting and heat-related illness. Arrive hydrated, bring water, and leave the room or rest whenever you need to.
Your health. You are responsible for deciding whether you are physically able to take part. Before your first class, and whenever your health changes, you agree to:
tell your instructor about any injury, medical condition, pregnancy or recent childbirth that may affect your practice
consult a doctor before taking part if you have any doubt about your fitness to exercise in heat, including during pregnancy or if you have a heart condition, high or low blood pressure, or a history of fainting
stop and tell the instructor if you feel pain, dizziness, faintness, nausea, shortness of breath or other symptoms
Our instructors are not medical professionals and their guidance is not medical advice.
Assumption of risk. You understand that taking part in hot yoga, spin, Pilates and other fitness classes and using our studios and equipment involves risks, including strains, sprains, falls, heat-related illness, equipment-related injury, and in rare cases serious injury, permanent disability or death. Some risks may not be known or foreseeable. You participate voluntarily and accept these risks.
Release. To the fullest extent permitted by law, you release and waive all claims against HotShop Corporation, its subsidiaries and affiliates, and their directors, officers, employees, instructors, contractors and agents (the "Releasees") for any injury, death, loss or property damage arising from your participation in our classes or use of our studios, equipment or Services, including claims caused by the negligence of the Releasees and claims under occupiers' liability law. You agree not to sue the Releasees for any such claim, and to indemnify them against claims brought by others arising from your participation.
This release does not apply to the extent Alberta law does not allow it, including for gross negligence or wilful misconduct.
Limit on liability. If any part of this release is found unenforceable, the Releasees' total liability to you is limited to the greater of (a) the amount you paid us in the 6 months before the event giving rise to the claim, and (b) $500, to the extent permitted by law.
Minors. For participants under 18, the parent or guardian acknowledges these risks on the minor's behalf and agrees to the separate Parental Acknowledgment of Risk and Indemnity.
7. Website, app and content
Our names, logos, class formats, photos, videos, text and other content on our website and app belong to HotShop or our licensors. You may use them for your own personal, non-commercial use only, and may not copy, republish or distribute them without our written permission.
Our website and app are provided "as is". We do not promise they will always be available, secure or error-free, and we may change or remove features at any time. If you download the HotShop app, the Apple App Store or Google Play terms also apply to your use of the app.
8. Communications
By creating an account, you agree to receive service messages by email and text, such as booking confirmations, reminders, waitlist notices, schedule changes, billing notices and policy updates. Marketing messages are sent only with your consent and you can unsubscribe at any time, as described in our Privacy Policy. Your mobile carrier's message and data rates may apply.
9. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, arising from your use of our Services. Nothing in these Terms limits any rights you have under Alberta consumer protection law that cannot be waived.
10. Governing law
These Terms are governed by the laws of Alberta and the federal laws of Canada that apply there. Any dispute will be heard in the courts of Alberta.
11. General
If any part of these Terms is found invalid or unenforceable, the rest remains in effect. These Terms, together with our Privacy Policy and posted studio policies, are the entire agreement between you and us about our Services. You may not transfer your account or these Terms to anyone else without our written consent. We may transfer these Terms to an affiliate or a buyer of our business.
12. Changes to these Terms
We may update these Terms from time to time.
